Dont worry they will not come. Set up through a local street shop your money will be saved and time, because they never come and they take advanced payment of rupee 5000. I HAVE SUFFERED.

Sub: Under warranty claim for replacement of Defective Epson Printer.
EPSON L 380 printer, Serial No X2Q5246838,
Date of purchase- 16/ 10/2017. Customer No IN7004582980,

This is in continuation to my letters of complaint sent through email onwards dt 14.11.2017 uptill 30.12.2017 which remained unattended and unresolved by Epson India Pvt Limited, Epson Authorised Service Center and by the authoriries of Epson India P Limited. In this connection please be informed as under:

1) That the customer purchased Epson printer model L380 bearing Serial number X2Q5246838 from your authorized dealers M/S Paytm through National Computech (57159), Bangalore Karnataka, Pin 560002 against cash memo number 29A0005715903186 dated 16.10.2017 for Rs 11,987/- vide Shipment number 2948763184, Order 3980163275, month and year of Import Aug 2017 along with warranty against manufacturing defect, hardware and software failure for a period of one year or upto 30,000 prints whichever is earlier. The Epson product (L380 printer) purchased by the consumer was guaranteed by the company through their advertisements to print documents and photographs with four color inks in color and black and white. (Refer to Annexure number )

2) That under the terms of the sale as specified above in para number 1, the under noted Epson authorities were directly and indirectly responsible to fulfill customer support and make good warranty claim for replacement of the aforesaid defective and nonworking Epson printer:

3) That complaint was lodged by the consumer on 14.11.2017 against the aforesaid printer containing a non-repairable manufacturing defect which
A. produced fake linings and dots while printing documents in standard quality mode of the aforesaid printer,
B. Black and cyan color missing with color shift in standard quality printing.
C. Printer failure and not working properly.
D. the complaint of fake lining generation during printing any document continued and spoiled media and papers up till printing 249 number of pages.

Since the complaints remained unattended for a period of 30 days onwards dt 23.11.2017 up-till dt 18.2.2017 Further a written complaint was lodged on 20. 12 2017 clearly stating that
A. Head or Nozzle failure was reported on dated 19.11.2017
B. The said printer failed in printing with black and cyan on any document
C. Printer producing linings with dots in standard quality mode.
D. Printer prints the documents with straight lining marks with faded colors.The printer prints the documents with straight lining marks with faded and fake colors on standard quality mode, black not being visible as true black overflows extra blank ink on end side.
E. Entire ink being consumed and emptied in printer maintenance / head cleaning by service engineers and printer flaws and failure to print true colors could not be rectified.
F. Print time being 5 minutes 25 seconds in High quality mode for glossy paper A4 size.
G. Complaint caused due to a non-repairable manufacturing defect and of recurring nature could not be resolved in repairing and printer head cleaning.
H. Complaints were lodged as the aforesaid Epson printer failed in working properly as per company specification mentioned in broucher .
I. Complaint attended and repair status is unavailable at Epson web page https://customer.epson.co.in/customer/repair.do#/IN
J. A warranty claim for replacement of the defective product was made by the customer with Epson India Pvt Limited and their authorized service center in Varanasi through Epson customer care toll free number and email.

Documentary evidences in support of complaint were also emailed by the consumer. That the Epson engineers visiting customer’s residence were all the times given access to all facilities including the defective printer with original Epson supplied ink, access to wifi, access to engineers personal mobile and laptop connectivity with defective printer, sitting arrangement, welcome with tea and water, power supply, good quality of media, computer connectivity with all sorts of software hardware calibration set free from any malfunction but the complaint against non-repairable manufacturing defect with the aforesaid printer remained unresolved.

4) That complaints being unattended and unresolved by Epson India private Limited and their authorized service centers, a warranty claim for replacement of the defective product was made by the customer and further complaints were lodged by the consumer through complaint ID issued by customer care call logs and by emails as under:

5) That Epson Service Center Varanasi along with Epson Area Manager Mr Maruti Misra accepted for consumer complaint being attended by Epson service engineers only on two occasions through email message.
“Pls refer my attached mail and confirm If you want to repair the same printer .
Already you are rejected to repair the same printer ….one more things our engineer is not consumed any ink because hardly we are attended your calls 2 times only” Maruti Kumar Mishra Dec 24, 2017 at 10:57 AM,

Wherein all call logs recorded in para 4 above are fraudulently reported as attended. The copy of consumer complaints recorded by Epson India P Ltd was emailed by Mr S Vishwanath S, DGM on dt 28.12.2017 which indicates that Epson authorities manipulated to close each and every unattended complaint by raising fake, concocted, willfully created and manipulated reports and send it to Epson Regional Office Delhi.

Further Service and repairing report was not updated on Epson Web page. Complaints were closed by false reporting as attended and complaint against printer head and nozzle failure to cause lining in standard mode along with printer failure to print black and cyan color were fraudulently changed in concocted language as consumer complaint into the aforesaid record emailed by the company DGM Epson India P Ltd New Delhi on 28.12.2017.

6) That deliberate illegal attempt was made by the Mr Maruti Misra, Area Manager of Epson company to hamper the interest of the consumer, and to willfully cause a lapse of consumer warranty period.
The consumer was ill treated by the authorities of Epson India P limited by email messages, conversation on mobile, by criminal offences of infringing consumer’s privacy within cunsumer’s premises and private room by making video and voice recording was done by Epson service engineer without knowledge of the consumer and privacy of third party not related with the matter was deliberately infringed under instigation from Mr Maruti Misra, Area Manager, Epson India P Ltd on mobile conversation with his service engineer. Repairing of Epson printer was denied in a pre -planned and illegal manner by the authorities of Epson company.
The Epson Area manager Lucknow (U.P.) always remained negligent in performing customer services. He not only refused to intimate Epson Lucknow Area Office address but also misbehaved with the customer in an abusive manner on 26.12.2017. He flatly denied to send any service engineer for onsite repairing of the defective product.

Attempts were made by the authorities and service center to cause great monetary losses and loss through mental tension and agony to the customer by applying unfair trade practices.

7) That there had been a deficiency in services and illegal force closure of unattended and unresolved complaints was committed with concocted and fake remarks by Epson India p limited and their authorities against the aforesaid Epson printer is narrated as under:

A. Complaint ID INC1004125700 dt 14.11.2017. Complaint against lining and dots, black missing with color shift in standard quality mode:

Wherein the complaint was attended by service engineer Mr Devendar Singh on 16.11.2017. Head cleaning and repairing was done with ink consumption from the aforesaid defective Epson printer and Head Cleaning report generated.

Service Report Columns as Reported problem, Observed problem and Rectification details willfully were left blank by the service engineer to deceive the consumer.

Since the aforesaid printer failed to print document with jpeg files properly in standard quality mode and continued producing fake linings with fake color, the consumer recorded his remarks against unresolved complaint on back of the Epson Customer Service Report RMA number INW5003215105 issued by the service engineer. (Refer to Annexure number )

Whereas Epson authorities willfully recorded customer complaint with manipulated and misleading remarks other than that reported by the customer as under:

Engineer visited and found there is no issue in the printer. But your reported problem was color difference compared to that of displayed in your computer. Which is not possible to get exact color as the printer used is Four Engineer tried to explain that your printer model L380 is under the category of document printer. This printer is with 4 colors. The document printer can also print on photo papers but it is not suggested for commercial purpose. In order to match the color, Customers should use the Appropriate professional Photo category printer alongwith RIPS software to caliberate and match the color of the monitor and printer output. Misleading Record issued by by Epson DGM by email on dt 28.12.2017.

B. Complaint ID number 4138397 dt 19.11.2017 and INC1004125700 dt. 20.11.2017. and Complaint ID number 4138397 dt. 20.11.2017.

• Wherein the complaint was attended by Epson service engineer Mr Vinod Kumar on 20.11.2017. Head cleaning and repairing was done with ink consumption.
• But the aforesaid printer failed to print document with jpeg files properly in standard quality mode and continued producing fake linings with fake color, black not being printed as black.
• The requisite columns of Service Report as Reported problem, Observed problem and Rectification details willfully were left blank by the service engineer to deceive the consumer.
Whereas the Epson Service Engineer recorded his remarks on Customer Service Report on dt 20.11.2017
“ Customer not satisfied with printing in standard mode”. Epson Service Engineer
The consumer recorded his complaint in remarks column on Epson Customer Service Report RMA number nil issued by the service engineer on dt 20.11.2017 under his signature and also recorded on back of the document in his own writing stating “Color variation in printing unresolved / printer head defective, produces false color” against unresolved complaint. (Refer to Annexure number )

Whereas Epson authorities willfully recorded customer complaint with manipulated and misleading remarks other than that reported by the customer with a view to force closure of unattended complaints as under:
Our engineer visited at customer site two time , now printer is working fine, customer need to photo printer, as a actual display photo print same to same want by print photo.

The above referred Complaints lodged onwards dt 23.11.2017 up-till dt 18.12.2017 were never attended by Epson Service Center and no one visited to resolve the complaint aginst the aforesaid defective Epson printer, contrary to it a force closure was done with fake and fabricated remarks by Epson authorities. Wherein Epson company or their authorities did not give any hear to customer’s complaint and remained negligent.

When contacted the Epson service center Varanasi on 19.12.2017, the customer was diverted to contact Epson Area manager on mobile number 9838200251 who replied that he was driving his car hence unable to consider any request. He further asked the consumer to SMS the printer number which the consumer already been sent to him by SMS and email.
E. complaint ID INC1004176201 dt 29.11.2017

That call log against complaint ID INC1004176201 dt 29.11.2017 was closed with manipulated and concocted record as attended. Cyber crime was commited by service engineer in back date” in absence of Customer Service Report. Printer was wrongly reported as working. Pls refer my mail dated on 22-11-2017.

Adding to that:
This is the Document printer with four color and if you are looking for better color reproduction from the printer , you have to go for six color printer and use calibration with monitor and printer for getting better output. One more things the media you are using is not a good quality of media. You have logged the call yesterday but if you are out of station how we can attend the call , when you are coming Varanasi log the call once again ….Regards (email message sent by Epson Area Manager Mr Maruti Misra on 29.11.2017)

the consumer also sent his complaint through SMS to Epson Area Manager, Mr Maruti Misra on his mobile number on dt 17,12.2017 but all in vain. (Refer to Annexure number )
The complaint being unresolved and continuing after repairing a written complaint was lodged by email and through letter of complaint dt 19.12.2017 sent by post. “Printer was wrongly” Service Report dt 01.12.2017. Misleading Record issued by by Epson DGM by email on dt 28.12.2017.

“The issue reported was the same hence explained customer” Misleading Record issued by by Epson DGM by email on dt 28.12.2017.

J. Complaints lodged onwards dt 23.11.2017 up-till dt 18.12.2017:

The Area Manager, Epson India Pvt Ltd Lucknow Division, Mr Maruti Kumar Mishra, summoned the consumer on 29.11.2017 with a new fabricated, fake version defamatory to the consumer, pre-thought charges created with a view to void warranty period, motivated with unfair trade practices, overlooking and deliberately hampering the interest of the consumer. The consumer objected to the versions of Epson Area Manager Mr Maruti Misra that “the consumer was not using a good quality of media i.e. paper for printing”: His version is being quoted here under:

Adding to that :

K. Complaint ID number by email dt 21.12.2017
Fault with printer nozzle missing was recorded by Epson service engineer Mr Devendar Singh on 21.12.2017. Complaints were also made on Customer Service Sheet issued by Epson authorized service centers and reported to Epson Area Manager Mr Maruti Misra by the consumer / customer.

Print Nozzle check pattern report was taken out from the printer by service engineer Mr Sunil Pandey and signed by him on dt 21.12.2017 at page number 1102 printed by aforesaid printer as Print Nozzle check pattern.

Head cleaning and repairing was done with ink consumption. But the aforesaid printer failed to print document with jpeg files properly in standard quality mode and continued producing fake linings with fake color but they refused to repair the defective printer onsite leaving the complaint unresolved. When asked by the customer to record all requisite columns of Epson Service Report as Reported problem, Observed problem and Rectification details they wilfully left the same blank to deceive the consumer.

Onsite machine report as “Printer Information Check” was also generated by Mr Sunil Pandey in back date from his Laptop i.e. 01.12.2017 connecting his laptop and using customer’s CD for Epson software. He carried the Epson CD owned by the consumer and did not return customer’s Epson printer software CD back to the consumer on date of his visit i.e. 21.12.2017. He even never received customer’s mobile calls.
The Epson Service Engineer Mr Sunil Dubey accompanying with Mr Devendar Singh attending the aforesaid complaint offered the customer to take back a refund for the defective printer stating that the problem lies due to manufactuing defect. Epson Service Engineer Mr Sunil Dubey did not suggest onsite repairing and asked the complainant to opt for a cash refund which was a fraudulent attempt on his part to escape from the complaint against deficiency in services. Written complaint was lodged through email with Epson Area Manager, Mr Maruti Misra whereas the customer objected to misleading and wrong statements.

Customer’s call log / complaint number “IN7004582980” dt 21.12.2017 regarding onsite warranty being denied by service engineer Mr Sunil Pandey was closed with remarks

“False claim, Service Center never denied onsite support. FYI call was attended by our engineer Mr Devendar Singh on 21.12.2017.” Misleading Record issued by by Epson DGM by email on dt 28.12.2017.

L. Complaint ID number “IN7004582980” dt 22.12.2017

Epson Area Manager, Mr Maruti Kumar Mishra at Epson India Pvt Ltd, Lucknow Division, willfully expressed his negligence regarding customer’s previous complaints. The negligent act of Epson authorities causing service deficiency, neglecting to onsite warranty for replacement of defective product is being quoted hereunder:
“This time you are reported the different problem “Lining Issue” , Yesterday my engineer was visited at your place and tried to resolved your issue but you are not agree to repair the same printer. Kindly refer my mails once again regarding the Print quality of photos. We will resolved your lining issue , if you want to repair the same Printer. Kindly confirm. Regards 22.12.2017 at 11:02:13”

M. Complaint ID number “IN7004582980” dt 22.12.2017

Wherein the customer was offered to opt for replacement of the defective product model L380 with another six color printer as under by Mr Maruti Kumar Mishra Epson India Pvt Ltd Area Manager, Lucknow Division, on 22 Nov 2017 at 05:10:34 making good onsite warranty replacement with the defective Epson printer under reference,

The email message of Epson India Pvt Ltd Area Manager is appended below:

“Thanks for writing to us and we are about your concern …L380 is under the category of document printer. This printer is with 4 colours. The document printer can also print on photo papers but is not suggested for commercial purpose. If one wants to use the printer for printing photos then 6 colours photo printers is suggested. Regards.” Maruti

The consumer / complainant accepted the aforesaid offer and requested through email dt 25.12.2017 to provide onsite warranty replacement of the defective product by a six color printer or before 04.01.2018.

But Epson authorities or Epson Service Centre deliberately failed to respond to the offer for onsite exchange of defective printer under reference by a new six color printer and denied to under warranty claim for onsite repairing / replacement of the defective product.

The Epson Area Manager attempted to make void the under warranty commitment and again denied to his previous confirmation for warranty being applied. He charged the consumer with defamatory comment passed on 22.11.2017 through email that the printer was used for commercial purposes. Denial to make good warranty replacement by Epson company and its authorities is being quoted as under :

“We are never told that we are replacing said product with 6 Colour of printer …
Regarding the printing issue still I am waiting your confirmation that you want to repair or Not ? Nothing to add that My engineer was visited at your place but your denied to repair the same printer. Kindly refer my mail. Regards,”

N. Complaint ID number “IN7004582980” dt 22.12.2017

“You had logged the call but not allowed and supported engineer to check the printer, you had removed all ink from the printer and not allowed to check for any trouble other than color mismatch which you repeatedly reporting. But understand that you were demanding the replacement of the same issue of color mismatch but replacement will not meet your expectation which is beyond the specification of the printer.” Misleading Record issued by by Epson DGM by email on dt 28.12.2017.

O. Complaint ID number by email dt 24.12.2017
The customer also requested by email to provide onsite warranty / repairing on dt 25.12.2017 confirming that the same defect shall not repeat again in future with the aforesaid Epson printer but authorities of Epson company failed to depute service engineer and provide onsite warranty for replacement of non-repairable manufacturing defect of the aforesaid Epson printer. Contrary to it consumer’s request was over-looked and unnecessary emails were sent with intention to deliberately lapse the warranty period for the aforesaid printer as under

“Pls refer my attached mail and confirm If you want to repair the same printer .
Already you are rejected to repair the same printer ….one more things our engineer is not consumed any ink because hardly we are attended your calls 2 times only

R. Complaint ID number “INC1004263779”. dt 26.12.2017, Complaint lodged for printer failure,

Wherein the complaint was attended off late by the service engineers Mr Mr Sandeep Pandey and Vinod Kumar vide RMA number nil on dt 26.12.2017 at 2 pm instead of engineer Mr Vikrant. Head cleaning was performed by service engineers and ink was consumed from the aforesaid printer during repairing. They refused to repair the defective printer or part thereat onsite leaving the complaint unresolved.

Service engineers Mr Sandeep Pandey and Vinod Kumar acted unlawfully with a pre thought motive in privacy area of the consumer not being publically visible, misbehaved with the consumer under instigation and mobile conversation with Epson Area Manager Mr Maruti Misra at Epson Lucknow (U.P.), infringed the privacy of customer’s family members being third party. Epson service engineers overstepped their limits and boundaries, refused repairing of the aforesaid defective printer on dt 26.12.2017 and recorded a content within customer’s privacy for which they were not legally assigned by Epson India Pvt Limited as service provider or asked by the consumer.

Further they made a video and voice record after provoking the victim without his knowledge and consent which they should not have done as service engineers, and the second, that they attempted to record video of victims family members and belongings inside private room within premises of the customer for which they were not a party, performed a criminal offence latter published that information in public through emails with a motive to causing annoyance / inconvenience, to deceive and to mislead the addressee and recipient.

The act of deputing service engineers with pre thought malafide intention of Epson Area Manager Mr Maruti Misra to put the customer to harm and to willfully make photographs and video recording engineers on dt 26.12.2017 shows his pre thought planning for not getting the printer repaired and to safeguard himself from customer’s complaint against entire ink consumption by visiting service engineers during multiple Head cleaning on previous dates of complaint.

It implies a well thought and preplanned intent to commit a crime for not attending to repairing of the printer which is clear from the message emailed to the consumer by Epson Area Manager Mr Maruti Misra:
“Here I am attaching few photograph and voice recording it is indicating that you have taken all the ink from the Printer and not ready to provide to ink and media for testing purpose . Again my engineer was visited at your place to resolve the issue but you are not ready to repair the same printer . Regards

The Epson printer model L380 , Serial number X2Q5246838 was handed over to the service engineers for repairing on dt 26.12.2017 and it was the absolute responsibility of Epson Service Center, their Service Engineers and authorities to carry and bring with them within warranty period Epson ink in sufficient quantity, media and other necessary Epson components required at the point of onsite warranty for wastage, testing and replacement during repairing of aforesaid Epson printer bearing a non-repairable manufacturing defect as Nozzle failure already verified by Epson service engineers. Refusal to repair the defective printer by your Service Engineers on 26.12.2017 is considered as willful denial against making good warranty claim for replacement of defective Epson printer for which the customer is legally entitled for.

The complaint listed above still remains unresolved as the defective Epson printer under reference is not working properly, details already sent to you by email and forwarded to the Sr Manager Epson India P Limited, Corporate Center, Bangalore.

Whereas Epson authorities willfully terminated customer complaints with manipulated and misleading remarks other than that reported by the customer as under and direct refusal to repairing or replacement of defective product sold to the consumer has been made under warranty. The customer was served with a misleading Record issued by by Epson DGM by email on dt 28.12.2017 with false, fabricated and concocted charges levied upon the consumer.

The consumer has asked your service Centre to supply ink and submit the bill after repairing on dt 29.12.2017, which they denied on grounds that original ink is not available with them. Epson authorities even failed to inform the customer as to what quantity of printer ink is needed by your service engineer each time they attend customer's complaint and how much quantity of ink shall be consumed by them in Head cleaning. The customer also requested to inform the Office address of Area Manager (U.P.) Mr Maruti Misra but all in vain. Please be informed that onsite repairing of the aforesaid printer has been flatly and directly denied by your authorized service center.

Since a Nozzle failure of the aforesaid printer has been reported by your service engineer as such kindly inform the customer whether a repairing shall be done or the defective product has to be replaced and when. The consumer has been ill treated and persistently being harassed under instigation from Epson Area Manager Mr Maruti Misra. I do not understand as why Epson authorities are deliberately causing monetary losses to your valuable customer and compelling the consumer to refer the matter to his legal advisers for further action into the matter.

The customer / complainant has requested to do the needful to replace the above mentioned defective Epson L380 printer under warranty claim by another working Epson Printer in any brand with equivalent price and value within 15 days of the date of this letter i.e. on or before 04.01.2018 but all in vain failing which the consumer shall bound to refer the matter to his legal advisors for further legal action and compensation of all losses and damages caused by you parties into the matter on risk and responsibility of you opposite parties. Opposite parties / Respondents
You opposite parties are hereby being informed as under:

1) That the applicant / complainant is a senior citizen and a consumer of “Printing Services” of Epson L380 color printer bearing serial number X2Q5246838 purchased for his personal use from the authorized dealers of M/S Epson India P Limited, opposite party number 1. The service of which was agreed to be given by the opposite parties 1 to 14 above at the service point being complainant’s residence House No - K 44 / 19, Naik Bazar, Varanasi, 221001, with condition that the consumer is able to use these printing services through the said point of installation of the aforesaid printer by the service provider and connected with consumer’s computer set working in order free from all kinds of set and hardware and software faults / defects.

2) That the aforesaid Epson printer model L380 bearing Serial number X2Q5246838 was purchased by the consumer / complainant from the authorized dealers of you opposite party 1 above being M/S Paytm through National Computech (57159), Bangalore, Karnataka, Pin code 560002 against cash payment of Rs 11,987/- vide cash memo number 29A0005715903186 dated 16.10.2017, vide Shipment number 2948763184, Order number 3980163275, month and year of Import Aug 2017 along with onsite warranty for replacement / repairing against manufacturing defect, defective parts thereat along-with printer hardware and software failure for a period of one year or up-to 30,000 prints at the cost of you opposite parties number 1 to 14 above.

3) That you opposite parties number 1 and 2 above (being the principal service provider) M/S Epson India P Ltd (abbreviated Epson and also referred hereunder as Epson company) at Bangalore and New Delhi, you opposite party number 3 above being the Senior Manager customer services at Epson India P Ltd at Corporate Center Bangalore, you opposite parties number 4 being a DGM of Epson India P Ltd at Regional Controlling office, New Delhi; you opposite party number 5 above being Area Manager U.P. division of the Epson company, agreed to provide onsite printing services and warranty services against the aforesaid printer to the complainant vide Consumer / Customer No IN7004582980 through you opposite parties number 6 to 14 above. You opposite parties number 6 to 14 above being authorized service center, service coordinator, service engineers, owner and authorities of Epson authorized service center in Varanasi and in the capacity of for rendering proper services to the consumer on behalf of you opposite party number 1 above also agreed for rendering of services through Consumer / Customer No IN7004582980.

4) That you opposite parties number 1 to 14 above agreed to provide under warranty after sale services bought by the complainant under the terms and conditions of contract of services as mentioned above in para 1 to 3 of this letter.

Accordingly you opposite parties number 1 to 14 above were legally bound and directly and obliquely responsible to to fulfill customer support and to provide uninterrupted trouble-free printing services with the aforesaid printing machine (Epson L380 printer) sold to the consumer at specified printing speed and trouble free while printing documents and photographs with four color inks in color and in black without producing any fake or unnatural linings, dots or unnatural colors at the point of service i.e. at the residence of the complainant specified in Para 1 above.

5) That the aforesaid Epson printer purchased by the consumer failed in working properly on 14.11.2017 spoiling about 249 number of pages used by the consumer in printing of documents through aforesaid printer. The printer produced unnatural and fake lining with dots while printing any document or photos in color in standard quality mode of the aforesaid printer.

The consumer also contacted opposite parties on their mobile numbers to resolve the complaint lodged but all in vain. There had been a deliberate service deficiency on the part of you opposite parties number 1 to 14 above and unfair trade practice was applied by you opposite parties to lapse consumers warranty for the aforesaid product in a fraudulent way.

6) That the defect and deficiency in service given by you opposite parties was of continuing nature which originated and repeated very frequently, more or less daily and remained continuous for number of days since 14.11.2017 up till the last day of lodging this complaint i.e. on dt 10.01.2018 and onwards.

That the complaints against the service deficiency of “printing failure and generating unnatural / fake lining” in standard and high quality modes of the aforesaid printer (being non-repairable manufacturing defect) were not resolved by you opposite parties number 1 to 14 above, causing termination of contracted and agreed printing services to the consumer at the point of service.

7) That written and oral complaints were lodged by the consumer, with you opposite parties number 1 to 9 above, through customer care number 18004250011 and email ID on dt 14.11.2017 against the aforesaid non working printer and non-repairable manufacturing defect of the aforesaid printer as under:
A. The aforesaid printer produced unnatural and fake linings and dots while printing any document in standard quality mode of the aforesaid printer within the warranty period,
B. Black and cyan color missing with color shift in printing with standard quality mode of the aforesaid printer working with high configuration computer connectivity with all sorts of software hardware and monitor calibration set free from any malfunction.
C. There was a printer failure and same was not working properly.
D. the complaint of fake lining generation during printing any document being of recurring nature continued and spoiled media and papers up till printing 249 number of pages up-till dt 14.11.2017.

8) That the complaints being unattended and unresolved by you opposite parties number 1 to 14 above, within stipulated time limit of 3 days, further complaints were again lodged by the consumer through complaint ID issued by customer care call logs and by emails, the summary of which is given as under:

9) That since 14 Nov 2017 up till 03 January 2018 approximately more than 23 call logs were made by the consumer through complaint id issued by Epson Customer Care as recoded in Para number 7 of this letter and written complaints were also made through email with more than 40 reminders.

Consequently. requests / complaints were lodged by the consumer under warranty claim to rectify / remove the faults arising with the non-working printer and requests were made to replace the defective material with a properly working component or printer through Epson company customer care number 18004250011 and through email Ids and mobile numbers of you opposite parties number 1 to 14 above.

Wherein you opposite parties number 1 to 14 above willfully terminated customer complaints making manipulated and misleading remarks in Epson company record at your end which was always other than that reported by the customer. Direct refusal to onsite repairing or replacement of defective product sold to the consumer was persistently made by you opposite parties number 1 to 14 above under warranty period. The customer was served with a misleading Record issued by you opposite party number 4 above by email on dt 28.12.2017 with false, fabricated and concocted charges willfully levied upon the consumer.

10) That the photocopy of documentary evidences in support of complaints and reminders lodged by the consumer with you opposite parties number 1 to 14 above were sent through email ID. Complaints were also lodged with mobile number of you opposite parties number 3, 4, 5 above along-with you opposite parties 6, 7, 8 , 10 above though SMS on dt 19 Dec 2017 and onwards.

11) That complaints and reminders were also sent to opposite parties number 1 to 14 above vide email ID as under:

12) That the visiting Epson engineers, you opposite parties number 10 to 14 above, were all the times given access to all facilities including the aforesaid defective printer with original Epson supplied ink, access to wifi, access to engineers personal mobile and laptop connectivity with defective printer, sitting arrangement, power supply, good quality of media, access to computer connectivity with all sorts of software and hardware calibration set free from any malfunction.

Contrary to which the attending service engineers you opposite parties number 10 to 14 above never attended any complaint with a calibrated laptop or mobile device set free from any malfunction to connect the aforesaid printer for checking of the defects while attending to consumer complaints.

13) That except on dated 16.11.2017 on dt 20.11.2017, on dt 21.12.2017 and on 26.12.2017 the complaints made by the complainant were never attended by any Epson technician / Service engineer or by any Epson authority, while the aforesaid printer failed and was not in working order either during or after Epson service engineer’s visit.

Wherein, the remarks recorded by you opposite parties number 10 to 14 above over Customer Service Reports for Epson Printer L380; Serial Number: X2Q5246838 confirming the non manufacturing defect of the aforesaid printer is detailed as under:

14) Wherein, the unresolved and unattended complaints were written off by you opposite parties number 1 to 14 above from back of the customer and without customer’s knowledge with a malafide intension to lapse the warranty period for the aforesaid Epson printer.
You opposite parties made pre-planned force closure of complaints and changed the nature of complaint lodged by the consumer willfully manipulated with fake, contradictory, concocted remarks through SMS and email reply as under:

Printer Head failure / Printer Nozzle missing was reported against the aforesaid Epson printer on dated 19.11.2017 which was confirmed by Epson service engineer Mr Devendar Singh
The Epson Service Engineer Mr Sunil Dubey accompanying with Mr Devendar Singh attending the aforesaid complaint offered the customer to take back a refund for the defective printer stating that the problem lies due to non repairable manufacturing defect and of recurring nature, “You had logged the call but not allowed and supported engineer to check the printer, you had removed all ink from the printer and not allowed to check for any trouble other than color mismatch which you repeatedly reporting.

But understand that you were demanding the replacement of the same issue of color mismatch but replacement will not meet your expectation which is beyond the specification of the printer.”
“False claim, Service Center never denied onsite support. FYI call was attended by our engineer Mr Devendar Singh on 21.12.2017.”

Complaint dt 26.12.2017

Service engineers denied to onsite warranty at the cost of you opposite party number 1.
Service engineers opposite parties number 13 and 14 above infringed the privacy of the consumer and acted fraudulently against the interest of the consumer. When our engineer was tried to take the Photograph you also denied the same and stopped to take the photograph …you are also not signing on call report also ….
Today Engineer visited at Customer side found CIS Tank is empty, and Customer is not ready to provide INK for repairing purpose.

(Concocted service remarks already objected by email)

15) That a Nozzle failure was already notified by Epson service engineers you opposite party number 10 above on dt 21.12.2017. The aforesaid Epson printer model L380, Serial number X2Q5246838 was handed over to you opposite parties number 10 and 11above for repairing on dt 21.12.2017 and on dt 26.12.2017.

And it was the absolute responsibility of Epson Service Center you opposite parties number 6 to 9 along-with you opposite parties number 10 and 14 to carry and bring with them sufficient quantity of Epson original ink, good quality media and other necessary Epson components required at the point of onsite warranty for wastage, testing and replacement during repairing of aforesaid Epson printer within warranty period. Moreover it was also the absolute responsibility of you opposite parties number 6 to 14 to conform free supply all requisite basic requirements and components to the consumer during onsite warranty for repairing from the Epson authorities you opposite parties number 1 to 5.

16) That the printer Head failure / printer Nozzle missing was reported against the aforesaid Epson printer on dated 19.11.2017 which was confirmed by (Epson service engineer Mr Devendar Singh) you opposite party number 10 above on Customer Service Report issued on dt 21.12.2017.

Print Nozzle check pattern report was taken out from the aforesaid printer at page number 1102 by you opposite parties number 10 above and also signed by you opposite party on dt 21.12.2017 but onsite repairing was denied and a cash refund was offered by you opposite parties number 11 who accompanied with Service Engineer Mr Devendar Singh you opposite parties number 10 above.

You opposite party number 11 above (being Epson Service Engineer Mr Sunil Dubey) did not suggest onsite repairing and asked the complainant to opt for a cash refund which was a fraudulent attempt on his part to escape from the complaint against deficiency in services. The customer was also misguided by you opposite parties number 11 to sign a request for that on Customer Service Report dt 21.12.2017.

Print time with the aforesaid printer being 5 minutes 25 seconds in High quality mode for glossy paper A4 size, which was much higher than company specification for L380 printer model.

Ink was consumed in printer maintenance / head cleaning by visiting Epson service engineers and printer flaws and failure to print accurately with true colors could not be rectified during repairing and head cleaning by Epson Service engineers.

You opposite party number 11 above carried the Epson CD owned by the consumer and did not return customer’s Epson printer software CD back to the consumer on date of his visit i.e. 21.12.2017. He even never received customer’s mobile calls.

Complaint caused due to a non-repairable manufacturing defect and being of a recurring nature could not be resolved in repairing and printer head cleaning by the attending Epson service engineers. A fraudulent denial to replace the aforesaid defective product was made by you opposite party number 10 above.

That you opposite parties number 5 and 7 above accepted through email message for having attended consumer complaints through service engineers only for two times out of 23 call logs onwards 14.11.2017 uptill 03.01.2018.

Consequently, written complaint was lodged through email with Epson Area Manager, Mr Maruti Misra, you opposite party umber 5 above, whereas the customer objected to all misleading and wrong remarks willfully created by you opposite parties number 1 to 14 above.

Wherein all call logs recorded in para 4 above were fraudulently reported by you opposite parties number 1 to 13 above as attended with fake, concocted, willfully created and manipulated reports raised against complaints lodged by the customer and a force closure of complaints was made.

Service and repairing report for the aforesaid Epson printer was not updated on Epson Web page.

Customer’s complaints against printer head failure and nozzle missing causing printing of unnatural and fake lining in standard mode along with printer failure to print black and cyan color were fraudulently changed into the record of Epson company by you opposite parties 1 to 14 above, the copy of which emailed by the company DGM Epson India P Ltd New Delhi on 28.12.2017.

17) That you opposite party number 5 above being responsible to fulfill customer support onsite always ill-treated the consumer through concocted email messages, misleading conversation on mobile, by criminal offences of infringing consumer’s privacy within consumer’s premises and private room by making video and voice recording done through you opposite party number 13 and 14 above without knowledge of the consumer. The privacy of third party not related with the matter was deliberately infringed under instigation from you opposite party number 5 above on mobile conversation with his service engineer. Repairing of Epson printer was denied in a pre -planned and illegal manner by the authorities of Epson Company.

You opposite party number 5 above flatly denied to depute any service engineer for onsite repairing of the aforesaid defective product and always remained negligent in performing customer services. You opposite party not only refused to intimate Epson Lucknow Area Office address but also misbehaved with the customer in an abusive manner on 26.12.2017.

The act of deputing service engineers with pre thought malafide intention to willfully make photographs and video recording through you opposite parties number 12 and 13 above, on dt 26.12.2017 clearly shows a pre thought planning for not getting the printer repaired and to safeguard you opposite party number 5 above from customer’s complaint against entire ink consumption by visiting service engineers during multiple Head cleaning on previous dates of complaint and to put the customer to monetary losses.

18) That printer Head cleaning and repairing was done with ink consumption from the aforesaid printer ink tank during repairing and multiple head cleaning by you opposite parties number 13 and 14 above on dt 26.12.2017, but the aforesaid printer failed to properly print document with jpeg files in standard quality mode and continued producing fake linings with fake color.

Wherein Head cleaning report was also generated by you opposite parties but you opposite parties refused to repair the defective printer onsite leaving the complaint unresolved irrespective of the fact that the aforesaid printer contained original ink supplied by Epson company after multiple head cleaning by the you opposite parties number 10 to 14 above.

You opposite parties number 13 and 14 above Mr Sandeep Pandey and Vinod Kumar being the Service engineers, acted unlawfully on dt 26.12.2017 as a visiting engineer in privacy area of the consumer not being publically visible. You opposite parties acted illegally with a pre thought motive to deny repairing under warranty, misbehaved with the consumer, infringed the privacy of customer’s family members being third party under instigation and mobile conversation with you opposite party number 5 above on dt 26.12.2017.

Further you opposite party number 13 and 14 above illegally made a video and fabricated voice record after provoking the victim without his knowledge and consent which they should not have done as service engineers, and the second, that you opposite parties attempted to record video of victims family members and belongings inside private room within premises of the customer for which they were not a party, performed a criminal offence latter published that information in public through emails with a motive to causing annoyance / inconvenience, to deceive and to mislead the addressee and recipient.

Head cleaning and repairing was done with ink consumption and report was generated by you opposite party number 13 above. When asked by the customer to record all requisite columns of Epson Service Report as Reported problem, Observed problem and Rectification details you opposite parties willfully left the same blank to deceive the consumer. You opposite parties even did not ssue Epson Customer Service Report to the consumer. It implies a well thought and preplanned intention on the part of the Epson Service Center Engineers you opposite parties number 12 and 13 above under instigation from Epson authorities you opposite parties number 3 to 5 above to commit a crime for not attending to repairing of the printer, which is clear from the message emailed to the consumer by Epson Area Manager Mr Maruti Misra you opposite party number 5.

Service Report Columns as Reported problem, Observed problem and Rectification details willfully were left blank by you opposite parties to illegally make consumer’s warranty claim null and voide, in spite of Head cleaning and repairing being done with ink consumption from the aforesaid defective Epson printer and Head Cleaning report generated by you opposite party number 10 above.

Since the aforesaid printer failed to print document with jpeg files properly in standard quality mode and continued producing unnatural and fake linings with fake color, the consumer recorded his remarks against unresolved complaint on back of the Epson Customer Service Report RMA number INW5003215105 issued by the service engineer.

19) That the willful refusal to repair the defective printer by by you opposite parties 1 to 14 above on dated 21.12.2017 and on dated 26.12.2017 is considered as unfair trade practices and an illegal act for making null and void customer’s warranty claim for replacement of defective Epson printer for which the customer was legally entitled for.

The customer informed of the aforesaid printer to contain original Epson ink supplied by you opposite party number 1 above and also asked you opposite parties number 1 to 14 on dt 29.12.2017 to supply ink and submit the bill after repairing and also requested to you opposite party number 4 above through email, which you opposite parties number 1 to 14 have unlawfully denied on grounds that original ink was not available with you opposite parties number 6 to 13 above.

You opposite parties number 1 to 14 above even failed to inform the customer as to what quantity of printer ink was needed by you opposite parties number 6 to 14 each time they attend customer's complaint and how much quantity of ink was to be consumed to avoid repairing / replacement of the aforesaid defective and not working Epson printer.

20) That repair and complaint status for the aforesaid Epson printer illegally remained unavailable against each and every complaint number at Epson web page https://customer.epson.co.in/customer/repair.do#/IN and complaint status was never displayed on site by you opposite parties nuber 1 to 14 above.

Moreover the attending Epson Service engineers never issued the consumer any Epson Service Report / Job Card with printed serial number.

21) That after sale service warranty was all the times denied by you opposite parties against the agreed terms and conditions of onsite repairing or replacement of defective material / product with service ink and further illegally demanding to supply the consumer with unlimited amount of extra bottles of ink other than that contained in aforesaid printer ink tank. Services bought from the opposite parties remained terminated even due to refusal to supply original Epson ink by you opposite party number 1 to 14 above against valid cash memo.

You opposite parties number 1 to 14 never informed the customer nor replied when asked through email message as to the quantity of ink was required and the shop selling Epson ink. You opposite parties even failed to inform the customer as to what sort of repairing was to be done with aforesaid printer and attempted to escape from all complaint call logs made by the consumer.

Whereas, the consumer also visited you opposite party number 6 above with the aforesaid defective and non-working Epson printer and requested to deposit the same with you opposite parties number 6 to 9 above, but you opposite parties refused to do so.

22) That there had been a deficiency in services on the part of you opposite parties number 1 to 14 above. You opposite party number 4 above created a willful illegal force closure of all unattended and unresolved complaints with concocted, manipulated, misleading and fake remarks in Epson company records at your end, copy of which was sent by to the consumer by you opposite party number 4 above by email dt 28.12.2017 denying onsite warranty for replacement of the defective product.

23) Wherein onsite repairing being willfully denied by you opposite parties number 1 to 14 above, a warranty claim for replacement of the defective product was made by the customer through written letter dt 19.12.2017 sent by India Post on dt 21.12.2017 and a request was made to consider the same within 15 days of the date of this letter i.e. on or before 04 Jan 2018 with you opposite parties number 1 and 6 above, but all in vain.

24) That you opposite parties 1 to 14 above failed to provide uninterrupted / deficiency-less services to the consumer / complainant. Deficiency in services of continuing nature persisted with aforesaid Epson printer as frequent production of unnatural and fake lines in printing through the aforesaid Epson printing machine and of access to machine failure continued since 14.11.2012 up till dt 03.01.2018.

25) That you opposite parties being involved in practice of "planned obsolescence" - creating and selling products pre-designed for failure at some point and to lapse warranty period so that consumers be enticed to replace the product within warranty period and without any extension of warranty period.

And by using this techniques for placing a product on the market pre-designed for failure deliberately aimed to reduce Inkjet printers lifetime in order to increase the replacement rate, you opposite parties are responsible for the same. You opposite parties are involved in selling ink jet printers with pre-designed Head and Nozzles which fails and blocks prematurely even when "substantial ink" remains in the printer tank. You opposite parties by being involved into the breach of contract with its customer who is entitled to use all the ink in the ink tank trouble free. The aforesaid Epson Inkjet printer sold to the consumer is an evidence to that and the consumer is a victim of that.

26) That you opposite parties were all the time negligent after receiving repeated and continued complaints and reminders in making good on-site under warranty claim made by the customer against the recurring and non-repairable manufacturing defect of the aforesaid defective and non-working Epson printer and even thereafter whenever the complainant visited you opposite parties 6 to 9 personally for removal and resolution of complaints against deficiency in service and service failure.

27) That you opposite parties number 1 to 14 deliberately recorded (1) Print lead / Lamp warranty end date (2) Spare part warranty end date and (3) Labor warranty end date to be 27/09/2018 instead of 23.10.2017 based on the date of online delivery to the consumer on dt 24.10.2017.

You opposite parties have willfully terminated the contracted service since 14.11.2018 up till the printer remains dead and warranty made null and void defrauding the consumer.

28) That there had been a deficiency in services from the side of you opposite parties’ number 1 to14 above. Consequently final complaint was lodged by the complainant on dt 03.01.2017 through customer care number against printer failure, service failure, writing off all previous complaints with concocted and fabricated remarks, deficient services, fraudulent acts and unfair trade practices on the part of the service provider respondent / you opposite parties number 1 to 14 above being directly and vicariously liable.

29) That the customer / complainant also requested you opposite parties number 1 to 14 above vide letter dt 19.12.2017 to do the needful to replace the above mentioned defective Epson L380 printer under warranty claim by another working Epson Printer in any brand with equivalent price and value on or before 04.01.2018 and to extend the warranty of the aforesaid Epson printer for a period the complaint remained unattended and unresolved, but all in vain. Onsite repairing of the aforesaid printer has been flatly and directly denied by you opposite parties number 1 to 14 above by applying unfair trade practices for which you opposite parties number 1 to 14 above may be held liable into the court of justice.

30) That the complainant is a consumer of you opposite parties number 1 to 14 above through Consumer / Customer No IN7004582980, under Section 2 (d) of Consumer Protection Act 1986 and there is a deficiency of service on the part of you opposite parties number 1 to 14 above as stated in para number 5 to para number 29 of this letter.

You opposite parties number 1 to 14 above have willfully attempted to lapse the warranty for the aforesaid defective printer since 14.11.2017, caused the customer with a great monetary loss of Rupees 11,987/- being the price of the aforesaid printer paid, a sum of Rupees 5,000/ as typing and communication charges paid, loss through paper and media damages Rs 1000/-,, loss through ink wastage Rs 1056/-, loss through postal communication and internet charges Rs 2000/-, a sum of Rs 200,000/ being the amount of loss goddwill, and a sum of Rs 10,00,000/- through mental tension and agony total amount being Rs 12,21,043/- (Rs twelve lac twenty one thousand forty three only) along with other losses to be accessed by the legal advisor which you please are requested to pay to the consumer / complainant / undersigned within 3 days of the date of this letter i.e, on or before 14.01.2018 failing which the consumer shall be bound to refer the matter to his legal advisors for further legal action and compensation of all losses and damages caused by you parties into the matter on risk and responsibility of you opposite parties.

With reference to above I would like to bring to your kind notice that I had made a complaint for the non working of the printer on 15th of February, 2018 but the same has not been resolved till date. My office work is getting hampered on daily basis. I had purchased this printer from a reputed company Epson which is known for its after sale service but till date my problem regarding the printer had not been resolved. If the same cannot be repaired please inform us and take back the product you have sold. My day work has been hampered badly from the last week as the printer is not working, and I am facing a lot of problem as I am unable to print the documents for my clients. I am incurring huge monetary loss due to the same .

So I would request you to kindly look into the matter and resolve the same at the earliest. Either please get the problem resolved or please take back your product id it cannot be resolved

No one should buy a epson printer. We call them to repair our printer at 1st may and they said that we will come at 4th may and now it is 15nth may. i really say no one should buy any of epson product. such a bad response of there workers, dont know how to talk.
